1. Agreement
These Terms of Service (“Terms”) are a binding agreement between you (“you”, “user”) and EnglishHub Technologies Inc.(“EnglishHub”, “we”, “us”), governing your access to and use of the EnglishHub website, apps, and related services (collectively, the “Service”). By creating an account or using the Service, you accept these Terms. If you do not accept them, do not use the Service.
If you are using the Service on behalf of an organization (school, employer, customer), you represent that you have authority to bind that organization, and “you” refers to both you personally and that organization.
2. Eligibility
To use the Service, you must be at least 16 years old, or the minimum age of digital consent in your country, whichever is higher. If you are under 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf. We may require age verification and may refuse or terminate service to any user who cannot establish eligibility.
The Service is not directed to children under 13 (or the equivalent minimum age in your jurisdiction), and we do not knowingly collect personal data from such children. If you believe a child has provided us data, contact [email protected] and we will delete it.
3. Our services
The Service provides independent study materials and software tools designed to help users prepare for third-party English proficiency exams, including but not limited to CELPIP, IELTS Academic, IELTS General Training, PTE Academic, PTE Core, OET, and TOEFL iBT.
The Service includes, depending on your plan, practice tasks modeled on published exam formats, mock exams, automated feedback, lessons, progress tracking, and related features. We may add, remove, or change features at any time. We'll try to give reasonable notice of material changes.
4. No affiliation with exam providers
THIS IS IMPORTANT. EnglishHub is an independent third-party preparation platform. We are not affiliated with, endorsed by, sponsored by, or in any way officially connected to:
- Paragon Testing Enterprises (owner and administrator of the CELPIP test)
- IDP Education, the British Council, or Cambridge Assessment English (the joint owners and administrators of IELTS)
- Pearson plc and its subsidiaries (owners and administrators of PTE Academic and PTE Core)
- Cambridge Boxhill Language Assessment Trust (owner and administrator of the OET)
- Educational Testing Service (ETS) (owner and administrator of the TOEFL family of tests)
The names CELPIP®, IELTS®, PTE®, OET®, TOEFL®, and any related logos, marks, or exam-specific terminology are trademarks of their respective owners. EnglishHub uses these names solely for the purpose of describing the exams our study materials are designed to help users prepare for. Such use is nominative and does not imply any endorsement, affiliation, or sponsorship.
We do not reproduce real exam questions, nor do we have access to live or retired official exam content. All content on the Service is independently created by our team and licensors.
We do not register users for the real exam, administer the real exam, or influence real exam scoring in any way. To take a real exam, you must register directly with the relevant official provider.
5. Accounts
To access most features you need to create an account. You must provide accurate, current information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You may not share your account, transfer it, or allow others to use it. One person, one account. We may suspend or terminate accounts used in violation of this rule.
6. Subscriptions, billing, auto-renewal
Some features require a paid subscription (“Pro”). When you buy a subscription:
- You authorize us (and our payment processor, currently Stripe, Inc.) to charge your chosen payment method for the subscription fee plus any applicable taxes.
- Subscriptions automatically renew at the end of each billing period at the then-current price, unless you cancel before the renewal date.
- You can cancel at any time from your account settings. Cancellation stops future renewals; it does not refund the current billing period except as provided in the Refund Policy.
- Prices may change; we will notify you at least 30 days before any price change affects you, and you may cancel in that window.
- All amounts are shown in the currency displayed at checkout. You are responsible for any bank fees, currency conversion charges, or taxes due in your jurisdiction.
7. Refunds
Refunds are governed by our Refund Policy, which forms part of these Terms. In addition to anything stated there, nothing limits any non-waivable statutory refund rights you may have under the consumer laws of your country (for example the EU/UK 14-day cooling-off right for distance contracts, subject to its exceptions for digital content you began using before the cooling-off period expired).
8. Acceptable use
You agree NOT to:
- share your account, resell access, or use the Service to operate a competing preparation business without a written license from us
- scrape, crawl, download in bulk, mirror, or systematically copy content from the Service
- use the Service, its output, or its data to train a machine learning model or build a dataset for third parties
- reverse engineer, decompile, or attempt to extract the source code or algorithms of the Service, except to the extent this restriction is prohibited by applicable law
- upload malicious code, interfere with the Service's availability or security, or attempt to bypass rate limits or access controls
- impersonate another person or create an account using false information
- use the Service to engage in unlawful, harassing, hateful, fraudulent, or misleading conduct
- post content that infringes another person's intellectual property, privacy, or publicity rights
- use the Service to cheat on any real exam, or to distribute or solicit real exam questions
We may remove content or suspend accounts that violate these rules, at our discretion and without advance notice in serious cases.
9. User content
The Service lets you submit content — written responses, audio recordings, feedback, and similar (“User Content”). You keep ownership of your User Content. By submitting it, you grant EnglishHub a worldwide, royalty-free, non-exclusive license to host, store, reproduce, process, analyze, display, and transmit your User Content solely for the purpose of operating, providing, improving, and securing the Service.
We may anonymize and aggregate User Content for analytics and product improvement. We do not sell User Content to third parties. We do not use identifiable User Content for advertising.
You represent that your User Content is yours to share and that sharing it with us does not violate anyone else's rights.
10. Intellectual property
All content on the Service that is not User Content — including practice questions, lessons, scoring rubrics, software, designs, logos, text, audio, images, and documentation — is owned by EnglishHub or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial preparation. This license does not include any right to copy, redistribute, publicly perform, or create derivative works, except to the extent expressly allowed by us in writing or by applicable law.
The EnglishHub name and logo are trademarks of EnglishHub Technologies Inc.. Third-party trademarks (CELPIP®, IELTS®, PTE®, OET®, TOEFL®, and others) remain the property of their respective owners.
11. No guarantee of exam results
EnglishHub is a study tool. We do not guarantee, warrant, or promise that using the Service will result in any particular score, band, level, pass status, admission, visa, certification, license, registration, or other outcome. Results depend on many factors we cannot control, including your individual aptitude, study habits, health, test-day conditions, and the official provider's scoring. Any results displayed on the Service (practice scores, rubric estimates, band predictions) are for study guidance only and are not official and are not a prediction of your real result.
12. Third-party services
The Service integrates with third-party providers (payment processing, hosting, analytics, email delivery, speech processing, etc.). Your use of those providers may be subject to their own terms and privacy notices. We are not responsible for the acts or omissions of third parties.
External links on the Service lead to sites we don't control and don't endorse. Follow them at your own risk.
13. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, to the maximum extent permitted by law. Without limiting this, we specifically disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability, and security.
We don't warrant that the Service will be error-free, that defects will be corrected, or that the Service or its servers are free of viruses or harmful components.
Some jurisdictions do not allow the exclusion of implied warranties; in those places, the exclusions above apply to the extent legally permitted, and you may have additional statutory rights.
14. Limitation of liability
To the maximum extent permitted by law:
- EnglishHub, its affiliates, officers, employees, contractors, and licensors will NOT be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, goodwill, data, use, or business, arising out of or related to your use of (or inability to use) the Service, even if we've been advised of the possibility of such damages.
- Our total aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) one hundred United States dollars (US$100).
- These limits apply to all claims in the aggregate, regardless of the theory of liability (contract, tort, warranty, statute, or otherwise).
Nothing in this section limits liability that cannot be limited under applicable law — including, where applicable: (i) liability for death or personal injury caused by our negligence; (ii) liability for fraud or fraudulent misrepresentation; (iii) non-waivable consumer rights under the laws of the EU, UK, California, Australia, Canada, or other jurisdictions.
15. Indemnification
You agree to defend, indemnify, and hold harmless EnglishHub and its affiliates, officers, employees, and agents from any third-party claim, liability, damage, loss, or expense (including reasonable legal fees) arising out of or related to (a) your use of the Service, (b) your User Content, (c) your breach of these Terms, or (d) your violation of any law or the rights of any third party. We may take control of the defense of any matter for which you owe indemnification; in that case, you will cooperate with us at our request.
16. Termination
You may stop using the Service at any time and close your account.
We may suspend or terminate your access, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or created risk or legal exposure for EnglishHub or other users. We may also discontinue the Service (or any part of it) with reasonable notice.
On termination: your license to use the Service ends; we may delete your account and data, subject to our Privacy Policy and applicable law; and the provisions that are meant to survive termination (intellectual property, disclaimers, liability limits, indemnification, dispute resolution, governing law) will survive.
17. Governing law, disputes, region-specific rights
General
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law rules, and you and EnglishHub consent to the exclusive jurisdiction of the courts located in Toronto, Ontario for any dispute not subject to arbitration.
Informal resolution
Before filing a claim, you agree to contact [email protected] and give us 30 days to resolve your complaint.
Arbitration (U.S. users only)
If you reside in the United States, you and EnglishHub agree to resolve any dispute by binding individual arbitration, not in court, except that either party may bring an individual action in small claims court. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The seat of arbitration is Wilmington, Delaware, USA, and the language is English. You and we each waive the right to a jury trial and the right to participate in a class action, class arbitration, or representative proceeding. If this class-action waiver is found unenforceable, the entire arbitration agreement will be void with respect to that dispute.
EU/EEA, UK, Australia, California, and other non-waivable consumer protections
If you are a consumer resident in the European Union, the European Economic Area, the United Kingdom, Australia, California, or another jurisdiction whose law gives you non-waivable consumer rights, those rights apply in addition to these Terms. If anything in these Terms conflicts with your non-waivable rights, those rights prevail.
30-day opt-out (U.S. users)
You may opt out of the arbitration clause by emailing [email protected] within 30 days of first accepting these Terms. Include your account email and the words “Arbitration opt-out”. Opting out does not affect any other part of these Terms.
18. Changes to these terms
We may revise these Terms from time to time. When we make a material change, we will post the updated Terms and update the “Last updated” date. For significant changes, we will also give notice by email or in-app notification at least 14 days before the change takes effect. Continuing to use the Service after the change takes effect means you accept the revised Terms. If you don't accept them, you should stop using the Service and may cancel your subscription.
